Chris Cantell Discusses DRM: Obstacles with protection of authors' rights

Are you a fan of music? Do you download music files from the Internet or share them with other users? If the answer to these questions is yes, you should be careful, not to face different obstacles. These days you hear a lot about Amazon.com or Yahoo.com for example, which want to offer free music files without the protection of authors' rights. Even though, the question is, if this is legal.Yesterday the Europe's superior court handled a problem of protecting author's rights, due to the fact that Spanish Internet providers refused to identify customers sharing music online to the Spanish supporters of author's rights. Luxembourg-based European Court of Justice responded to this: "The protection of authors' rights can not affect the requirements of the protection of personal data"This case was brought to the Spanish court by a non-profit organization of music procedures and publishers, called Promusicae, because their revenues decreased sharply, due to pirated downloads and file-sharing. Telesommunication provider Telefonica, refused to hand over personal information. Promusicae wanted them to disclose identities and also addresses of people, to whom they had provided Internet access services. Telefonica said in its ruling, that consigning personal information was authorized in Spain only in criminal investigation or to defend public security and national defence.It was found out, that the rights of protection of property must be reconciled with privacy laws. This fact and also the ability of EU nations to obligate revealing of personal data was appreciated by a lot of industry groups, as well as individuals.

Problemy s ochranou autorskych prav

Ste hudobny fanusik? Zvyknete stahovat hudobne subory z Internetu, alebo ich zdielate s inymi uzivatelmi? Ak je odpovedou na tieto otazky ano, mali by ste byt opatrny, aby ste nemuseli celit ziadnym potiazam. V tychto dnoch sa mnoho dozvedame napriklad Amazon.com alebo Yahoo.com, ktori by chceli ponukat zadarmo hudbu bez ochrany autorskych prav. Ale je toto legalne? Vcera sa Europsky vrchny sud zaoberal problemom ochrany autorsych prav, kvoli tomu, ze Spanielski Intenetovi operatori odmietli identifikovat zakaznikov, ktori zdielali on-line hudbu a prezradit ich mena Spanielskym zastancom autorskych prav. Europsky sud Sparvodlivosti , zaoberajuci sa Luxemburskom, zareagoval takto: "Ochrana autorskych prav nemoze ovplyvnit ochranu osobnych udajov." Predtym bol tento pripad predlozeny Spanielskemu sudu neziskovou organizaciou hudobnych procedur a vydavatelov, menom Promusicae, kedze ich zisky prudko klesli, kvoli piratskym kopiam a zdielaniu suborov. Telekomunikacny operator Telefonica odmietol odovzdat osobne informacie. Promusicae od nich ziadala prezradenie identit a adries ludi, ktori vyuzivali ich sluzby pristupu na Internet. Telefonica povedala vo svojom odovodneni, ze prezradzanie osobnych informacii bolo v Spanielsku dovolene iba pocas kriminalneho vysetrovania alebo na ochranu verejnej bezpecnosti, ci narodnej ochrany. Zistilo sa, ze prava na ochranu majetku musia byt v prerobene, aby boli v sulade s osobnymi pravami. Tento fakt a taktiez schopnost europskych narodov odmietnut odovzdanie osobnych udajov bolo ocenene mnohymi priemyselnymi skupinami, ako aj jednotlivcami.

Qtrax Casts Off The Vow Of Free Online Music Service

Many of serious questions concerning future strategies of music industry have been discussed in Cannes last weekend. Names like Chad Hurley, co-founder of YouTube, Joanna Shields, Bebo international president, Yahoo (NSDQ: YHOO) Music GM Ian Rogers, Steve Purdham, We7 CEO, Guy Hands, the new owner of British major EMI have appeared on the annual industry meeting. According to the valuation report, the music business is coming down, hardly surviving a huge crises, due to free internet sharing and downloading, simply called network piracy. The crises is calling for new alternative business models. Despite of increasing number of internet subscribers, which has advanced the strategy of online sales, provided by Apple Inc.'s iTunes or Amazon, the report claims they couldn't cover music industry losses. One of the most discussed topic, concerned Qtrax, ad-supported music service, that promised to lead off the sharing of its free online music. The initial plan featured the number of one million music tracks. The company reports that over 61,000 unique users per hour are using the Qtrax software by midday. The agreement was about to unravel, when a rejection came. Warmer Music Group Corp. declassified their attitude of no authorizing the firm to distribute it's artists music. This attitude was held by other major recording companies, Vivendi SA's Universal Music Group and Britain's EMI Group PLC. Allan Klepfisz, Qtrax President and Chief Executive admitted the difficulties while negotiating with the labels. For now, Qtrax's ambitious and courageous promise is about to fail, although Klepfisz declared an expectation to put off the service in the following months.

SigEx Telecom : To download or not to download?That is the question

According to Wikipedia, DRM is an umbrella term that refers to access control technologies used by publishers and other copyright holders to limit usage of digital media or devices. Apple and Amazon.com recently announced some 'DRM-free' music initiatives. This won't mean the end of Digital Rights Management. The amount of digital content flowing over telecommunications networks is huge and will continue to grow so we most certainly need DRM regulations. Many online music stores use DRM to restrict usage of music purchased and downloaded online. Some Online music stores like eMusic, Audio Lunchbox, and Anthology recordings do not use DRM. Steve Jobs has made a call on the music industry to eliminate DRM in an open letter titled Thoughts on Music. This letter was published on February 6, 2007 and it talks about the history and the future of DRM software. Steve Jobs' letter got responses from Jon Lech Johansen, MP3.com founder Michael Robertson, Warner Music boss Edgar Bronfman and others. Sometimes I find these initiatives very funny. People are worrying about copyright laws and DRM in America and in Europe people are downloading music, movies and so on absolutely free.They're even downloading Microsoft software for zero cents. I know it's easier to download music, especially when it's free but I don't like the quality of it. I like to buy the albums of the artists I like, I like to pay a movie ticket to see an actor or a director I like...and the quality is superior to my PC at home.

I don't really understand this idea of multiple broadband internet connections being used at the same time. I know we're evolving and technology is evolving but is this IP TV really necessary?Shouldn't technology evolve by developing things we don't have and need or improving things we have but aren't working right?

Something new on horizon

There has been so mush fuss over the latest Apple product, the iPhone that it comes as a surprise the fact that the newest AT&T and eMusic release has no compatibility with it. For those that like having two in one product, you will enjoy the over-the-air music store that will combine your cellular phone with the functions oh an iPod. The eMusic store will be packed with 2.7 million songs in DRM-free MP3 format. Not only that you will download the desired song on your mobile, but a copy will be sent instantly to your computer. Don't cheer yet, there is the negative side to come. It is very expensive to purchase the data charges, the price will be $7.49 per five-pack plus data charges. Also it is quite disappointing that it is available only for Samsung's a717, a727, SYNC and the Nokia N75, but not for the iPhone. It does amaze me that the mobile phone created to be just like an iPod and have functions of a computer is not included in the range. However, it might be introduced in the range that is supposed to come. If it wasn't for the high price and the fact that works only for those type of mobile phones mentioned above, I would definitely acquire it. It is a step in the good direction and why shouldn't we purchase music from the mobile phone. There are situations when you have to do it. Of course I like and consider much easier to shop music from the computer, I would still try the mobile, perhaps because I like to be in trends. Surf on and shop till you drop or don't have any money.
